Roane County Court Record Requests
Every records request begins with the court that heard the case. Two statewide tools cover most of the ground. WVPASS opens public Circuit Court records and documents. That access covers Circuit and Family filings dated July 1, 1999 and later. MCRSearch gives free Magistrate Court case information, though it lacks the filed document images. Locally, Circuit Clerk Andrea Stockner holds the Roane County Circuit and Family files. Cynthia L. Morgan serves as Magistrate Court Clerk. She keeps the misdemeanor, traffic, small-claims, personal-safety, and other Magistrate records. A case number makes any request faster. Include the case style. Also list the document title or date, the number of copies, and whether you need a plain or certified version. Roane County offers no dedicated email request address or certified-copy web form. A phone call can identify the file and confirm current instructions, but the request itself may still need to go by mail or at the counter.
- Identify the court level, case number, and exact paper or date range needed.
- Search WVPASS for Circuit records or MCRSearch for Magistrate case information.
- For a missing document, call or visit the clerk, or mail a written request to that custodian.
- State whether the copy may be plain or must bear the clerk's certification.
- Confirm cost, accepted payment, retrieval time, and delivery method before sending funds.
Three Roane County Record Forms
Three forms of a record, three different jobs. A docket is the chronological index of a case. It lists events, filings, settings, orders, and outcomes, which makes it the best tool for narrowing a request. A filed document is the real thing: the motion, complaint, order, judgment, or notice behind an entry. A certified copy is a document the clerk has authenticated as true to the official file. Each online tool fits a different slot. WVPASS lets anyone browse case details for free and buy available document images. But those downloads carry no certification. MCRSearch shows Magistrate case data, events, charge and judgment blocks, and docket entries. Copy requests go back to the local clerk. Planning to use a Roane County court record for something official? Ask the recipient what form it requires, and ask the clerk for the current certification charge. A portal printout may display the right filing. Only the record custodian can issue an authenticated copy of it.
Kinds of Court Records
Jurisdiction, not subject, splits the county's records between the two clerk offices. The Circuit Clerk's side is the broader one. Those files include felony, civil, Family Court, juvenile, abuse-and-neglect, appeal, and related Circuit Court matters. Some of those files are confidential. The clerk still keeps them, even though access is limited. The Magistrate Clerk handles smaller matters. Her side covers limited-jurisdiction criminal and civil cases, traffic tickets among them, plus small claims. Municipal ordinance cases stay with the municipality whenever a municipal court handles the matter.
- Docket sheets and dated registers of filings, service, settings, orders, and judgments
- Complaints, petitions, answers, motions, notices, and other filed pleadings
- Signed orders, final judgments, criminal dispositions, and appeal papers
- Public Circuit and Family documents available through WVPASS
- Magistrate criminal, traffic, small-claims, and protective-matter files
- Recordings or transcripts requested under the rules that govern the hearing
A hearing transcript will not always be waiting in the clerk's file. Family Court rules offer a path. A party can request a recording through the Circuit Clerk. Name the case style and the hearing date. An independent reporter or transcription service then prepares the transcript at the requester's cost.
Roane County Magistrate Record Copies
Treat MCRSearch as an index, not a document repository. Search it by first name, last name, or case number. It returns no more than 30 records at a time. The disclaimer is blunt. A result is not a complete civil or criminal history. Once a docket entry points to the complaint, order, citation, or judgment you need, the next step is a copy request. Send it to the Roane County Magistrate Court Clerk.

Call Cynthia L. Morgan's office before you send anything. Ask whether the file is public. Ask how many pages it runs and whether advance payment is required. Rule 11 sets the ordinary photocopy rate. The clerk can quote the certification charge for Roane. A request that seems unreasonably burdensome may be delayed or denied. Narrow it down with a document date or title whenever you can.
Court Records: What They Contain
Think of the docket as the master index to the case file. It ties one case identifier to parties, attorneys, money received, process, filings, and court action. Papers named in those entries may sit beneath it as document images. Access can vary field by field and document by document. A redacted filing often stays public. Its private identifiers stay hidden.
| Case Number | The court's identifier, which should be copied exactly, such as the Magistrate format ##-M##X-#####. |
|---|---|
| Pleadings | Complaints, petitions, answers, motions, and notices that start or shape the case. |
| Orders & Judgments | Signed rulings, final outcomes, obligations, convictions, or dismissals entered by the court. |
| Docket Sheet | A dated sequence of filings, service returns, hearings, pleas, rulings, and disposition entries. |
| Events & Parties | Case style, party roles, counsel, judge or magistrate, setting date, location, and event status when public. |
| Financial Fields | Fees, bond, fines, costs, restitution, judgment or balance when the case system exposes them. |
A record can also tie cases together through an appeal, transfer, consolidation, or companion matter. A closed entry does not always mean the whole case has ended. Read the most recent disposition and order, then confirm any consequential result with the clerk.
Older Roane County Court Records
WVPASS only reaches public Circuit filings made on or after July 1, 1999. Anything older lives somewhere else. Paper files, microfilm, other preserved media, or an archive box may hold it. The clerk sometimes needs advance notice to pull it. State law lets officials preserve cases as indexed electronic or microphotographic copies. A retention schedule can then authorize destroying the originals.
Roane County adds a hard historical edge. Its first two courthouses, built in 1856 and 1887, both burned. Every record held in those buildings was destroyed. An indexed electronic docket can sometimes rebuild a later file that went missing. No system can bring back what the fires took. For genealogy and local-history work, plan on archival sources beyond the current court file. One caution: a blank online result may just mean age, court level, indexing, or access limits kept the case out of view. It is not proof the case never existed.
Copy Fees and Certification
A plain copy is just a reproduction of a public document. A certified copy carries the clerk's authentication. A court, agency, or other recipient may demand it. The rates are not interchangeable either. WVPASS charges its own fee for viewing or downloading public Circuit documents. The Circuit Clerk statute sets a different rate for a paper copy meant to leave the office. Magistrate administrative rules carry a separate photocopy charge.
| Item | Amount |
|---|---|
| WVPASS case-detail browsing | Free |
| WVPASS document view or download | $0.25 per page, plus nominal card fee |
| Magistrate Court photocopy | $0.25 per page |
| Circuit Clerk copy or paper made to leave office | $1 per page |

| Abstract of judgment | $5 |

The Circuit Clerk fee statute backs the one-dollar copy rate. Certification was not listed in a current county schedule, so confirm the total and payment method before mailing money.
Roane County WVPASS Purchases
Before buying documents on WVPASS, a public user must create a free account. Registration runs through email verification plus two-factor authentication. Each account allows just one active session. The limits are loose in some ways and tight in others. There is no daily cap on case searches. There is no ceiling on downloads. Yet no bulk-download tool and no automatic case-update notices exist. Search and case-detail review stay free.
Every purchase sits in the account's history for 30 days. A failed or interrupted download can be retried from that history without paying again. The service works with current Chrome, Firefox, Safari, and Edge browsers and is built for mobile use. Still, the portal copy is not certified. Ask the Roane County Circuit Clerk for a certified copy, or for any document missing from the electronic record.
Access Rules for Court Records
West Virginia law opens with public inspection. Then it lets statute, court rule, or a specific sealing order close the door. Juvenile, adoption, abuse-and-neglect, domestic-violence, and protected Family Court material may be unavailable as a result. Rules also bar full Social Security numbers, driver's-license numbers, account and card numbers, PINs, and passwords from public electronic filings. So even a public case can carry a withheld or redacted document.
Key Rules:
West Virginia Code § 51-4-2 makes court papers open to inspection and requires copies unless access is specially limited.
West Virginia Code § 29B-1-3 provides reasonable inspection and copying of public records, including electronic form when available.
West Virginia Code § 29B-1-4 preserves exemptions for material made confidential by law or court rule.
Trial Court Rules 10 and 15A control access limits, private data, and public electronic dockets. Missing a result? Check the spelling, filing year, and court first. Then ask the clerk whether the record is archived, sealed, restricted, or simply not yet indexed.
Mailing a Roane County Record Request
A written request works best when staff can identify a real record from it. Name the correct court. Give the case number and style if you have them. Add the document title or filing date. State the number of copies and whether they should be plain or certified. Then add your contact information, a phone number for questions, and your preferred pickup or mailing method. Ask the office about payment and response time before the package goes out.
Mail Circuit and Family requests to Andrea Stockner, Roane County Circuit Clerk, P.O. Box 122, Spencer, WV 25276. Magistrate requests go instead to the Magistrate Court Clerk. That office sits at 208 Court Street, Spencer, WV 25276. A formal West Virginia Freedom of Information Act request must reach the particular custodian holding the record. It does not go to some generic state office. Remember what the access law does and does not do. It covers existing public records. It never forces a clerk to build a new summary or research report for you.
